Family of Man Hit Crossing Street in Beverly Hills Sues Uber, Driver

BEVERLY HILLS, CA — The widow and three sons of an 85-year-old man struck and killed last year in Beverly Hills by a vehicle driven by an Uber employee are suing the ride-hailing company and the man who was behind the wheel.

Shahin Ohebsion Dayani and her offspring, Hank, H. Sean and Hooman Dayani, are seeking unspecified damages in their wrongful death lawsuit, filed Tuesday in Los Angeles Superior Court against Uber and driver Albert Hakoupians.

Uber spokeswoman Brooke Anderson said that the company does not comment on pending litigation.

Davoud "David" Dayani of Beverly Hills was walking in a crosswalk at Foothill Road and Third Street on Dec. 8 when he was struck by a 2015 Toyota Prius driven by Hakoupians, who was on the clock for Uber at the time, according to the complaint. The man died five days later.

The plaintiffs are "informed and believe" that at the time of the accident, Hakoupians was distracted by using an electronic device to communicate with or through Uber, the suit says.
