Selectmen Approve $90,000 Settlement for Greenwich Mom Who Claimed Negligence Caused Son's Injury

The student at Julian Curtiss School was injured was he fell from gymnastic rings during a 2012 class.

The Board of Selectmen unanimously voted to settle a lawsuit brought by a Greenwich mother and her son, who claimed the Greenwich Board of Education was negligent for not providing a safe environment when her son was injured in a gymnastics class at Julian Curtiss school.

Madeline Frost filed the legal action after her then 10-year-old son suffered a fractured elbow when he fell from gymnastic rings at Julian Curtiss in February 2012. In the lawsuit, Frost claimed the school failed to provide a safe school setting, a protective fall zone and a safe environment in the gym class so that elevated gymnastic equipment, including the rings, could be used safely.

The selectmen approved the settlement at its meeting Thursday following an executive session with town attorneys.

The settlement already was approved by the Representative Town Meeting’s 10-member Claims Committee. It now must be approved by the 12-member Board of Estimate and Taxation.
