Weston Police Charge Westport Man With DUI

Weston Police arrested a Westport man and charged him with driving under the influence of alcohol following a report of erratic operation of a motor vehicle on Newtown Turnpike on Friday, Oct. 21 at 1:02 p.m.

According to police, Brandon Dempsky, 39, of Westport was also charged with failure to drive in the proper lane and operating a motor vehicle while using a hand held mobile phone to send text messages.

Weston Police responded to the complaint in the area of Blue Spruce Circle and observed the driver straddling the double yellow lines. After police initiated a motor vehicle stop, near the intersection of Valley Forge Road, “the vehicle drove up onto the curb and then came to an abrupt stop,” police wrote in a report.

“Upon contact with the operator, I could smell a heavy odor of an alcoholic-type beverage,” police wrote. When officers asked Dempsky for his license, registration and proof of insurance, police noticed the driver’s eyes were “bloodshot and glassy.” Dempsky then handed police a credit card.

Police advised Dempsky that he had been stopped for erratic operation. He told officers “he was operating erratically because he was using his mobile phone to text his father.”

Dempsky then failed field sobriety tests and was taken into custody.

“A red plastic drinking cup was found in the cupholder with a blue drink residue,” police wrote. “A half-full blue bottle of Gatorade was found on the passenger floor. The liquid inside the Gatorade tested positive for alcohol.”

“While in processing, Dempsky was uncooperative at times,” police wrote. “When asked to come up to submit to the Breathalyzer test, his response was ‘come and make me.’ Dempsky also stated several times that someone was going to get punched before this was all over. While Dempsky was on the phone with his girlfriend, he stated to her that the DUI could have been from the cocktails he had [that] morning before he left. Dempsky than turned to [an officer] and said, ‘you didn’t hear that.’”

He was released on a $500 bond and given an Oct. 28 court date.
