Naperville Sued Over Smart Meter Patent Infringement

The lawsuit asks the court to award damages adequate to compensate for Naperville's alleged infringement.

A Florida-based business is suing the City of Naperville over allegations that the city’s smart meters violate a patent held by the business.

Atlas IP, LLC filed the complaint in district court Nov. 30. In the complaint, Atlas alleges that the smart meters and access points within infringe on the claims of the ‘734 patent before the expiration. The business also claims it has been injured by the city’s infringement.

Among the accusations listed by Atlas is the ability for the smart meters to power off during times other than when the meter is either receiving or transmitting data.

Atlas is asking the court to award damages adequate to compensate for Naperville’s infringement, as well as further relief deemed appropriate by the court.

Judge Sharon Johnson Coleman will be presiding over the case.
