New Lenox Files For Condemnation to Connect Nelson Road
Negotiations for the land needed to extend Nelson Road broke down, according to the court filing.
The Village of New Lenox began condemnation proceedings to acquire the land needed to extend Nelson Road.
The village filed against the owners of the land—Pentagon Properties and PDV—as well as BP Pipelines and Enterprise TE Products Pipeline.
“The village has attempted to negotiate with each owner of record in good faith to reach a bona fide agreement as to fair and just compensation to be paid for the property rights sought to be condemned in this action,” according to a complaint filed in Will County court.

“The village sent a final offer letter to each owner, the terms of which were not accepted,” the complaint said.
In July, the village passed an ordinance “authorizing the condemnation of the property rights sought herein for public roadway construction of Nelson Road, between Spencer Road and Haven Avenue,” the complaint said. Nelson Road abruptly ends at a farm field on Haven Avenue.

Extending the road is “necessary to accommodate current and future growth within the village, for both residential and commercial developments,” the complaint said.
