Developer at Fault for Shop Owner's Fall on Ice: Lawsuit

The former owner of a coffee shop at Ninety7Fifty said the developer didn't properly remove ice near her storefront, causing her to fall.

The former owner of the first business in Orland Park’s highly touted Ninety7Fifty on the Park apartment complex claims the developer’s negligence led to her slipping and injuring her back.

Giovanna O’Malley, who owned the now-defunct coffee shop Amano Vivere Café, is suing developer Flaherty & Collins, alleging their failure to remove “unnatural accumulations of ice” caused her fall early one morning in February 2014, Tribune Media reports.

O’Malley had just arrived to prepare to open the store around 3:30 a.m., when she slipped on the ice near the store’s entrance, according to the report. Her injuries required surgery and affected her employment. O’Malley also claims in the lawsuit that the developer of the $63 million complex failed to properly light the sidewalk to make the ice more noticeable.

She is seeking $50,000 for injuries and damages.

Her shop closed in July after a year in business.
