Jane Does Battle in Court Over Posts on Cheater Websites

Who are you calling a cheater, plaintiff Jane Doe asks in lawsuit filed in Oakland County Circuit Court.

A Metro Detroit woman who was called out on four websites for allegedly sleeping with married men has filed a defamation lawsuit in Oakland County Circuit Court in a battle between a couple of Jane Does.

It seems Jane Doe the defendant, posting under the screen name of “Rollergirl,” accused Jane Doe the plaintiff of having an affair with her husband and being a lying, drug- and alcohol-abusing adulterer.

The defendant allegedly made “a variety of intemperate and vile comments denigrating (the plaintiff’s) character, according to the lawsuit, and posted plaintiff Doe’s picture, too, The Oakland Press reports.

The plaintiff learned of the posts on one of the four sites, “Cheaterville,” in September 2014. She claims she doesn’t know who “Rollergirl” is, and said in her court petition that the allegations are false.

The Cheaterville website initially didn’t remove the posts, but agreed to abide by the decision of an arbitrator, who found the post was “unsubstantiated, erroneous, or otherwise maliciously motivated without case.” The post was removed in October 2014.

The URL for CheaterVille, which was previously named in a federal lawsuit by a happily married California couple after the husband was accused of looking for gay sex on Craigslist, now directs to a site called BullyVille. The operators of the website said that though they believed a forum to expose cheaters should exist, a convicted felon apparently had used the site to make posts about women he was stalking.

It’s unclear if the California case, filed in 2013 by Jared Powers and Winona Valdez, is still active. At the time, ABC News legal expert Dan Abrams said winning the case could be tricky because websites are protected from user-generated content. To win, the couple would have to prove the website is involved in the creation of slanderous, libelous content.

After Cheaterville removed the posts against the plaintiff In Michigan, posts were made on three other websites — Bad Boy Report, Cheater Report and Dating Complaints. In one of those posts, plaintiff Doe was called a “sociopath liar.”

“She at one time was my best friend,” the post read. “She loved to get high on Jack Daniels. Little did I know her drinking would impair her judgment and she would hop in the sack with my man.”

One post was made as recently as June 29 and appeared to have originated in Michigan.

Informed of the arbitration decision regarding the post on CheaterVille, one of the sites reportedly removed a post, but the plaintiff had to hire a professional to get the other two sites to take down the posts, according to the lawsuit.

Plaintiff Doe seeks damages in excess of $25,000, attorney fees and court costs, as well as an injunction preventing defendant Doe from making similar statements about her.
