Man Charged With First-Degree Criminal Sexual Conduct in Lakeville Incident

A 39-year-old St. Paul man was being held in the Dakota County Jail on Wednesday afternoon in connection to a sexual assault that allegedly occurred in a Lakeville home last month.

The incident reportedly left a woman hospitalized and in need of emergency surgery.

Francisco Cleofus Mountain has been charged with five felony counts, including two counts of first-degree criminal sexual conduct. Bond in the case stands at $175,000 without conditions.

Mountain originally was arrested on April 27 and charged three days later with terroristic threats and domestic assault.

The original Dakota County criminal complaint was amended on Tuesday to include the criminal sexual conduct charges and one count of felony assault.

Mountain made his first appearance in Dakota County District Court on the original two charges on April 30. He then appeared for his omnibus hearing on Tuesday.

According to the original complaint, Lakeville police responded to a residence at about 3:30 a.m. April 27, when they found the victim sitting in an entryway. She was bleeding and had blood on her arms and hands. The victim was taken to a local hospital to be treated for her injuries.

Police executed a search warrant at the residence later that day.

Mountain was arrested at about 3 p.m. April 27 when he attempted to visit the victim at the hospital.

Each of the criminal sexual conduct charges is punishable by 12 to 30 years in jail and/or a fine of $12,000 and $40,000. The first-degree assault charge is punishable by up to 20 years in jail and/or a fine of $9,000 to $30,000. Each of the other two felony charges is punishable by up to five years in jail and/or a fine of $3,000 to $10,000.

The original complaint says Mountain has four domestic violence-related convictions: for violation of an order for protection in 2006, domestic assault and second-degree assault in 2007 and domestic assault in 2012. 

In addition to the charges related to the Lakeville incident, Mountain is being held on a felony probation violation charge from Ramsey County.
