DEP Files Eminent Domain Proceedings Against Five Point Beach Homeowners

Properties range in value from $438,000 to $2 million.

The state Department of Environmental Protection has begun eminent domain proceedings against five Point Pleasant Beach homeowners for the Army Corps of Engineers beach replenishment project, according to the Ocean Star.

The properties are all located on Beacon Lane, near the Bay Head border. The condemnation actions were filed against the Bayhead Point Homeowners Association; Gina M. Addeo; Steven Fisher; and Ihab Girgis and Lisa Gualberti-Girgis.

“NJDEP is authorized to to acquire by condemnation the lands or rights needed to complete a $512 million Army Corps of Engineers [ACOE] beach replenishment project along the shoreline in Ocean County,” the complaint states. “NJDEP has determined that it is necessary and proper to acquire the land, premises, property and rights herinafter described, for public purpose, and specifically for flood hazard risk reduction measures.”

All of the property owners have been offered compensation for the full amount of the approved appraised value of the properties, which range from $438,000 to $2 million, according to tax records.
