Man Gets 3 1/2 Years in Prison for Attempting to Have Sex with 10-Year-Old Girl

A Fishkill man will serve three-and-half years in prison after he pleaded guilty to trying to arrange a sexual meeting a 10-year-old girl in Yonkers last year, the Westchester County District Attorney’s Office announced today.

Robert Viggiano, 50, of Fishkill, will serve the sentence after he pleaded guilty to one count of attempted rape in the first-degree.

Viggiano, who is married and a father, allegedly approached a prostitute in Yonkers and asked her if she could arrange for him to have sex with a virgin, 10-year-old girl.

The prostitute told Yonkers police about Viggiano’s request and police started an undercover investigation with the district attorney’s office.

An undercover police officer posed as the mother of a 10-year-old virgin maintained contact with Viggiano for a couple of weeks. The parties eventually came to an arrangement and agreed to meet at an apartment where Viggiano would bring $400 and candy for the victim.

Police said they arrested Viggiano at the location on Feb. 11. 2011. He allegedly had $400, a package of Skittles and a lollipop in his possession at the time of his arrest. 

In addition to the prison sentence, Viggiano must serve 10 years post-release supervision and register as sex offender under Megan’s Law upon his release.

Assistant District Attorney Kenneth Borden of the Special Prosecutions Division prosecuted the case.
