Cage The Elephant Sued By Concertgoer After Guitar Toss At Ascend Amphitheater
A Chicago man says he was struck by guitar during a raucous Cage the Elephant show at Ascend Amphitheater in May 2016.
NASHVILLE, TN — A Chicago man is suing raucous psychedelic garage rockers Cage the Elephant, saying he was injured by a guitar sent skyward by the band's lead guitarist at a concert at Nashville's Ascend Amphitheater last summer.
According to the Nashville Scene, Weston Tolbert alleges he was hit in the face after guitarist Brad Shultz threw his instrument into the audience May 19, 2016, causing "significant injury."
The suit further claims that Shultz was intoxicated, based on Tolbert's familiarity with Shultz and the band based on time he or a family worked for or with the band, along with witnesses who say Shultz drinking on stage, according to the Scene. Tolbert is seeking $350,000 in the suit filed in Davidson County Circuit Court and has named not just Shutz and the band as defendants, but also the band's LLC and concert promoter Live Nation.
“[Cage the Elephant, its LLC and Live Nation] were aware that [Shultz] had previously thrown his guitar at concerts and they failed to warn the patrons of this action or prevent [Shultz] from continuing this negligent act,” the suit reads.

Shultz declined comment to the Scene. Live Nation did not immediately return a request for comment.
