Border Patrol Shooting Injures One, FBI Leads Probe

Customs says agents shot a man who was shooting at them. He suffered non-life threatening injuries.

The FBI is probing a shooting involving Border Patrol agents that left one person injured. it happened Wednesday afternoon on State Route 80 just north of Tombstone. A driver who fired at agents suffered non-life threatening injuries.

Customs officials say that two agents were at a checkpoint at the intersection of State Route 80 and State Route 82.

They were on foot when a black 2008 Dodge Dakota crashed through the checkpoint, the driver firing out the window as he sped by.

The agents, fearing for their lives, returned fire, according to Customs officials.

The driver - since identified as 76-year-old Gary Smith of Tombstone - was hit in the upper left arm. He was taken to a hospital in Tucson where he was treated and taken into custody.
