First Amendment and Privacy

You might not know when you move into an HOA you lose long treasured American Constitutional Rights. You are forced to sign the private contract or buy somewhere else. You have no negotiating powers and that contract you signed is subject to change ... by them! Attorneys representing the HOA industry are working hard to tighten this up. An example ... you don't like the HOA, a friend is thinking about buying a property near you. Can you say this is an HOA to avoid? I dunno. But if you're going to dis your HOA or the Board, check with an attorney. Another example ... the Board added cameras in the common area. Did the Board give you a heads up? Do you know you are being videoed? Do you have any privacy rights or can the watchdog, Chucky Cheese, pass images of you putting out a cigarette on a concrete wall? How about zooming in see your daughter in her skimpiest bikini? Use your imagination other images may be exploited. They'll say, the cameras are in your best interest ... LOL. What stops Chucky Cheese from posting images on the internet? This is subversion, not a community.

Is there a work around? You might think living beside the board member would be a good thing. But Board members don't make good neighbors. Assume you get to know them, they get to see you're a good guy. When Gladys Kravitz peers into your backyard and screams "stop feeding the birds. They leave a mess on my patio." that is the control personality. Board members and the Governing Documents steal every ounce of joy from property ownership. Before you do anything on the exterior you must get permission then wait 12 weeks for an answer. Permission, permission, & more permission. And never forget the while your current board gave you permission, the next board can take it away ... you may need to redo what was approved. Living in an HOA does not resemble a community, it's a commune of conformity. You need not dare to adventure, for it is in an HOA where you rot from beige. Push back if rights are important.

HOA's are a war zone. Prepare to be bombed.
