Closed Session - Teachers Union Contract for 2015-17 and 2017-18

There is nothing in this Agreement that benefits students.
No Class Size Reductions.
No Restoration of District Funded Art Music or Science
CUSD has failed to comply with Public Disclosure Laws. Contracts entered into illegally are not enforceable.

At the April 13, 2016 BOT Meeting page 274: Recommendation of Tentative Agreement with Capistrano Unified Education Association (CUEA) for July 1, 2015 - June 30, 2017 Discussion/Action
On April 13, 2016 the CUSD Trustees approved a two year contract that provided Teachers with a:
- 4% Salary Schedule Increase
- 4% One-time off Schedule Bonus
- Health and Welfare Benefit Increases
The cost of this agreement was $18.6 million ($10 million in on-going expenses and $8.6 million in one time bonus money) for both the 2015-16 and 2016-17.
CUEA is proposing to get the same contract for 2017-18 plus there are some egregious MOU's that have never been disclosed to the Public. (MOUs are listed below).
8% compensation increase + health and welfare benefit increase for 3 years (2015-16, 2016-17 and 2017-18) if CUEA gets what it is asking for.
MOU's
1) Pilot MOU Kinoshita TK & K hours of employment. Period 2015-16 and 2016-17 executed 2-18-16 + Side Letter Pilot Program 2016-17 executed 7-25-17.
This was the only MOU that was made Public at a Board meeting and was open for Information/Discussion. CUSD was in violation of EdCode because it failed to have the same length of day for Kinoshita Elementary schools TK and K programs as required by law. This resolution was for a waiver.
2) ACE Day/Open House Adjustment for 2016-17 executed 7-25-16
3) ACE Day/Back to School Night Adjustment for 2016-17 and 2018-19 executed 7-25-16
If the Calendar is set so that Open House and Back to School do not fall on ACE days- Teachers actually gain 2 more early days out which cuts instructional minutes for students.
4) Priority enrollment of employees over all others including Mello Roos School of Choice 2016-17 and 2017-18 executed 7-25-16
This MOU would give District Employees priority over students for admission into impacted schools.
5) Middle School Duties July 1, 2016 - June 30, 2018 executed 7-25-16
This MOU removed teachers from being Middle School Campus Supervisors.
6) Pilot 50 students in a PE Class 2016-17 executed 7-25-16 re-negotiate 2017-18
This MOU was a pilot to test having PE Class Sizes of 50
7) Relieve Teachers from elementary school duties 2016-17 executed 7-25-17
This MOU removed teachers from being Elementary School Campus Supervisors.
8) Teacher Evaluations effective July 1, 2016 executed 7-25-17
This MOU wants to use self evaluations for Teacher evaluations.
9) Financial Compensation for Professional Development for 2016-17 executed 6-1-16
This MOU pays teachers for Professional Development taken over the Summer, and to pay substitute teachers to allow Teachers to do Professional Development during the school year.
10) Financial Compensation Special Education for 2016-17 executed 7-25-16
