Hate Crime Charges For Pair Accused Of Attacking SJ State Student, Yelling Anti-Gay Slurs

SAN JOSE, CA — Two men have been charged with hate crimes for allegedly attacking a San Jose State University student while yelling anti-gay slurs on the campus over the weekend, prosecutors said Wednesday.

Josue Medina Flores, 19, of Sunnyvale, and Christian Gabriel Nunez Petty, 20, of Fremont, face felony assault charges with hate crime allegations and were set for arraignment Wednesday afternoon at the Hall of Justice in San Jose, according to the Santa Clara County District Attorney's Office.

Prosecutors said the attack occurred around 3:45 a.m. Saturday when the victim and two female friends walked past the two men, who asked if he was gay and yelled slurs. When the victim and his friends ignored them and kept walking, the pair allegedly ran up and attacked him, punching him in the head and kicking him.

When one of the female friends jumped on top of the victim to shield him from the blows, the two defendants allegedly struck her too, according to the District Attorney's Office.

Campus police arrested the pair before they could flee from the campus, while the victim was treated at a hospital for his injuries and was later released, prosecutors said.

"If you hurt someone because of their race, religion, gender, or sexuality, you will be arrested and prosecuted," District Attorney Jeff Rosen said in a statement. "Tolerance and diversity are cherished values in this community. We back up them with one voice -- and the full might of the law."

The District Attorney's Office says its prosecutors have filed 14 hate crime cases so far in 2026.
