In October 2010, Wymer and Aver, allegedly created images of child, who Avers has custody of at the time, being molested. And in August 2011, Wymer and Davis allegedly used another child to create pornographic images. That child was in Davis’ custody during the alleged abuse.

Members of the Federal Bureau of Investigation and the Sacramento Internet Crimes against Children Task Force began investigating the Citrus Heights resident when a parent of another child accidentally texted him a photo of her eight-year-old daughter. Soon after, she received texts with sexually explicit dialogue accompanied by requests for photos of the girl.

The girl’s mother gave the phone to the FBI. Then, an undercover agent began impersonating the eight-year-old. After several weeks of explicit texts messages and chats, investigators were able to locate Wymer, the statement reports.

“Upon his arrest, law enforcement found photos of Wymer, Avers and Davis using children to create child pornography,” states the release. “Additional investigation determined that the child in the photos were minor relatives of Avers and Davis.”

If convicted, Wymer and Avers face a maximum penalty for producing child pornography or 30 years in prison. Their sentence would be determined at the court’s discretion after consideration of any applicable statutory factors and federal sentencing guidelines.

The case was brought as part of “Project Safe Childhood.” Department of Justice officials launched the nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse in 2006.
