Changes To Gilroy Accessory Dwelling Unit Regulations To Be Reviewed At Planning Commission
The City of Gilroy is considering adopting new Accessory Dwelling Unit (ADU) zoning regulations to comply with state law.

The City of Gilroy is considering adopting new Accessory Dwelling Unit (ADU) zoning regulations to comply with state law. On January 1, 2020, the state established new rules that invalidated the existing City ADU ordinance. The new state regulations allow construction of one 1,200 square foot accessory dwelling unit and one 500 square foot junior accessory dwelling unit with a single-family residence, and multiple accessory dwelling units on multi-family developed properties. The prior City ADU ordinance had limited an accessory dwelling unit size at 600 square feet and one-bedroom. Under the current City ordinance, ADU’s were only permitted on residentially zoned property developed with no more than one single-family residence, and subject to a 6-foot side and rear setback. The new City ADU ordinance proposes to set the maximum ADU size at 1,000 square feet, allow an ADU to be built above a detached garage, and implements the remainder of state law.

The Planning Commission is scheduled to review the draft ordinance on May 14th. A staff report and draft ordinance will be available for review online prior to the upcoming Planning Commission and City Council hearings at: http://gilroyca.iqm2.com/Citizens/default.aspx
