On Wednsday July 10, 2013 the Wildomar City Council will be discussing zoning ordinance amendment no. 13-02 to amend section 17.172.205 (Fences) to establish height and location standards for fences and walls in the City of Wildomar. This is Item 2.1 on the council agenda.
The Planning Commission has worked on this item during 2 meetings starting back in February and this is the best they could come up with?
The first questionalbe item is the title. It should say “standards for fences, walls and landscape. (Landscape being hedges, shrubs, trees, etc..
The second item is table D-1 Maximum Height of Fences and Walls in Required Yard Areas the section titled “At intersections of streets, alleys, and driveways within the clear visibility area” has a note 3 rather than dimensions.
Note 3 states 3. Fences/Walls located at intersections of streets, alleys, and driveways must maintain clear visibility as defined by the City Engineer. (This note should include landscape and contain dimensions).
All new construction must go before the planning commission therefore the City Engineer has input, but for existing developments the city needs to make clear the dimensions required and that they apply to everyone. This is so typical of the city to make changes that leave the citizen guessing what is allowed or doing whatever they want until someone is seriously injured or killed. Many intersections with dangerous obstructions will remain setting up the city for further lawsuits as there are countless federal and state guidelines available to establish these dimensions.
Many cities such as Irvine, Coronado, Sacramento, etc. have the dimensions for line of sight listed in the ordinance so the citizens know what is expected of them and why. One such guideline can be found at http://www.cityofirvine.org/civica/filebank/blobdload.asp?BlobID=11585
