SANTA MONICA, CA — The three adult children of a 92-year-old Venice man killed after being struck while riding an e-scooter filed a wrongful death suit Monday against the city of Los Angeles and the woman allegedly driving the car that hit him.
Carrie Rose, Bonnie Teates and Lori Terrell, the family of Army veteran Richard Allen Pinard, brought the suit in Santa Monica Superior Court against the city and the driver, Lindsey Hiatt, seeking unspecified damages.
A representative for the City Attorney's Office did not immediately reply to a request for comment.
Pinard regularly rode a bicycle or a scooter around the Venice boardwalk. On April 5, Hiatt was driving a 2025 Hyundai Venue south on Sanborn Avenue and turning right turn onto westbound Washington Boulevard when she drove into the path of Pinard's e-scooter, failing to see the elderly man, the suit alleges.
Pinard was ejected from the scooter and suffered catastrophic injuries, including a traumatic brain hemorrhage and a large laceration to the back of his head, according to the lawsuit, which further states that he died four days later at Ronald Reagan UCLA Medical Center in Westwood.
The intersection of Washington Boulevard and Sanborn Avenue, and the roadway and bicycle lane through it, were in a dangerous condition at the time because the roadway striping and pavement markings did not delineate the bicycle lane through the intersection, the suit states. The markings also failed to alert motorists of the bicycle lane's presence when they turned right from Sanborn Avenue onto Washington Boulevard, the suit further states.
The plaintiffs have lost the comfort, care, companionship, protection, affection, moral support, and guidance of their father, according to the suit.
