Menlo Park Shooting Suspect Turns Self In

Police say the man walked into the police station to turn himself in for the weekend shooting.

MENLO PARK, CA — A man accused of shooting a gun outside a Menlo Park home because he was "upset due to a loud party next door" turned himself into authorities on Wednesday, police said. Jose Gutierrez had been sought in connection with the Saturday night shooting which prompted a SWAT response in town.

The incident, which took place in the 100 block of Sevier Avenue in Belle Haven, was reported around 11 p.m. Saturday, according to Menlo Park Police.

"Upon arrival, officers set up a perimeter around the residence and attempted to contact occupants inside the subject’s home," police said after the incident occurred. "Officers were unable to obtain a response from anyone who might be in the home. According to witness accounts of the incident, it was believed that a male subject may still be in the home armed with an illegal firearm."

Officers got a search warrant and the San Mateo South County Regional Special Weapons and Tactics team went into the home around 8:57 a.m. Sunday and searched for the suspect, police said.

The SWAT team didn't find the suspect, but allegedly found an AR-style rifle in the suspect's residence and evidence of a shooting, according to police.

Police put out a call for Gutierrez after the incident and warned the public that he was considered armed and dangerous.

Jail records show Gutierrez was booked into the San Mateo County jail on charges of discharging a firearm with gross negligence and possession of stolen property. His bail was set at $50,000.
