Murrieta Probationer Accused of Illegally Procuring, Selling Prescription Drugs Arraigned

He's accused of using fake prescriptions to get drugs, and then selling them on the street.

MURRIETA, CA - A probationer accused of procuring opiates and other drugs by using fake prescriptions, then selling the pills on the street, pleaded not guilty Tuesday to forgery and other felonies.

Brian William Boswell, 45, of Murrieta was arrested in September along with his wife, 43-year-old Malia Lei Boswell, and convicted felon Tracy Rose Baker, 41 -- all of Murrieta -- following a Riverside County sheriff's investigation.

Along with forgery, the trio were charged with burglary and identity theft.

Brian Boswell was arraigned before Riverside County Superior Court Judge Richard Fields, who scheduled a felony settlement conference for Jan. 12 at the Riverside Hall of Justice.

Boswell is free on $10,000 bail. His wife is also free on bond and is slated to be arraigned on Dec. 27. Baker's next court date is Dec. 21. She's being held in lieu of $30,000 bail at the Smith Correctional Facility in Banning.

The trio came to the attention of the Southwest Corridor Narcotics Task Force after investigators received tips alleging that one or all were involved in falsifying prescriptions and presenting them to pharmacists in the Temecula area to obtain painkillers and other drugs, according to sheriff's Sgt. James Woodland.

Woodland said the defendants allegedly turned around and sold the narcotics in criminal circles.

After acquiring sufficient evidence, detectives obtained warrants to search the defendants' respective residences, where "fraudulently obtained prescription narcotics were seized," Woodland said.

The trio were arrested without incident.

According to court records, Brian Boswell has prior convictions for transportation of illegal drugs for sale, being in possession of controlled substances and driving on a revoked license.
