12-Year-Old Girl Sexually Assaulted By College Student In SMC Dorm Room: Report

The 19-year-old college student told police he believed the victim was 17 but knew she was still underage, prosecutors said.

MENLO PARK, CA — A 19-year-old Menlo College student has been charged with sexually assaulting a 12-year-old girl in his dorm room earlier this month, according to a report by KRON4.

Andres Manuel Aguilar, a San Jose resident, faces charges of aggravated sexual assault of a child, aggravated sexual assault of a minor involving oral copulation, and furnishing cannabis to a minor under 14, the San Mateo County District Attorney's Office said. He did not enter a plea at his initial arraignment Friday and remains in custody with no bail, KRON4 reported.

Aguilar met the victim on May 5 after she snuck out of her home — the two had previously met at a Menlo Park bus stop, where she told him she was 17 — and security footage shows them entering his dorm room after stopping at a Redwood City Safeway for beer and rum, according to KRON4.

Aguilar told Atherton police he believed the victim was 17, but acknowledged to investigators that he knew that was still underage, KRON4 reported.

The case is scheduled to return to court Thursday.
