The Power of Authority Granted to CUSD Clark Hampton is to great

Resolution No. 1314-25 dated November 6, 2013 must be RESCINDED.

CUSDWatch: The Power of Authority Granted to the President, and Clerk of the Board, or their designee to execute legal documents on behalf of the District is to Broad. It has resulted in the GIFTING OF PUBLIC ASSETS in the amount of $13 million dollars to The Ranch. Resolution No. 1314-25 dated November 6, 2013 must be RESCINDED. Deputy Superintendent Clark Hampton is using that same authority to negotiate more land deals that are not in the best interest of taxpayers. Clark Hampton is not a licensed Real Estate Broker or an attorney and should NOT have the power to negotiate land deals that harm taxpayers.

WARNING! Clark Hampton is currently negotiating 3 more land transactions in addition to the Esencia K-8 School Site purchase. He must be stopped before any more taxpayer assets are wasted.

On July 31, 2017, I filed a complaint with the Bureau of Real Estate regarding the gifting of $13 million dollars to the Ranch, when CUSD agreed to pay $2.4 million per acre for the Esencia School site by agreeing to value the site as if it had entitlements to build 100 homes on it. THER ARE NO ENTITLEMENTS.

The complaint was based on the fact that Clark Hampton, Deputy Superintendent of Support Services negotiated this deal on behalf of CUSD, and he is NOT a licensed real estate broker, or an attorney.

The response from the Bureau of Real Estate stated that the authority to NEGOTIATE LAND DEALS without a license was granted to the Deputy Superintendent and the Superintendent or their designee by Resolution No. 1314-25 (2) and (3) dated November 6, 2013.

To protect taxpayers this authority must be rescinded immediately. Mr. Hampton is currently in negotiations on three more land deals: Pacifica San Juan, Dana Point Bus Yard and Paseo Los Colinas in Laguna Niguel. These deals have not been conducted in a manner that protects the financial interests of taxpayers, and a complaint has been filed with the Orange County District Attorney's Office.

I am asking the current Board of Trustees to take this power away from Clark Hampton and Superintendent Vital, and to protect the financial interest of taxpayers whom Trustees have a fiduciary duty to protect.
