SUPERINTENDENT OF SCHOOLS
The Superintendent is the chief executive officer and educational leader of the district. He/she executes all Governing Board decisions and is accountable to the Board for managing the schools in accordance with the Board's policies. He/she informs the Board about school programs, practices and problems and offers professional advice on items requiring Board action, with appropriate recommendations based on thorough study and analysis.
The Board delegates to the Superintendent the power to make decisions concerning internal operations of the district. The Superintendent may delegate to other school staff any duties imposed upon him/her by the policies or vote of the Board, as far as the law permits. This delegation of power or duty shall not relieve the Superintendent of responsibility for actions taken by his/her designees.
The Superintendent shall have general supervision of all personnel and shall develop and execute consistent, fair and fiscally sound personnel procedures and practices, including an evaluation program for all district employees. He/she shall oversee all financial operations of the district and actively seek out new funding sources for the schools.
The Superintendent shall take an active leadership role in the development and improvement of the instructional program.
He/she shall be accessible to community members and shall work with them to further the district's goals and build a strong, positive community attitude toward the school system.
The Board expects the Superintendent to remain current on educational thought and practices in the interest of improving the district's instructional program and overall operation. The Superintendent shall inform the Board and staff of new developments and significant events in the field of education.
| Blue Card: Dawn Urbanek Under "Local Control", the LCAP is the only tool that the State of California gives to the Public to ensure transparency in how a district sets it's educational priorities, and how district funds are spent to ensure those priorities are met. It is very troubling that Staff has been allowed to put CUSD's LCAP on the Consent Calendar without any presentation of the data and discussion CUSD's performance in meeting it's stated goals. |
Especially troubling is CUSD's final LCAP Review Statement "
"Capistrano Unified Education Association and the District agree that employees are the District's greatest asset in delivering programs and services to students. The District will be unable to achieve desired results without employees. Providing time for teacher collaboration, engaging in aligned and coherent professional learning, and recruiting and retaining qualified teachers are all essential components to pupil progress."
Since Kristen Vital has been Superintendent, CUSD has shifted priorities away from what is in the educational interest of students, to what is in the financial interests of employees. This will be the 5th consecutive year of across the board compensation increases for employees totaling over $150 million dollars should the Board approve tonights budget.
CUSD has insufficient funding to pay for district funded Art, Music or Science (core educational classes that are required by the state for any student to receive a “minimum” education that aligns with State Content Standards and Curriculum Frameworks).
CUSD has facilities that have not been fixed or maintained for 15 years. There are facilities issues which considered "Emergency Repairs" and threaten the health and safety of students.
CUSD students attend school in overcrowded classrooms with staff to student ratios that are not safe.
CUSD has limited programing based on the Canadian model of education and the work of Michael Fullan- Trustee Hatton-Hodsons business partner in Systems Leadership Collaborative. Michael Fullan’s work is based on the belief that Professional Development is the number one priority for an educational institution.

Class size and differentiated learning do not matter. In alignment with these beliefs, CUSD Staff has eliminated funding for GATE, and other programming for high achieving students and continues to increase class size to fund compensation increases and time out of the classroom for Professional Development.
All CUSD teachers are chronically absent- out of the classroom more than 10 days a year.
CUSD is the only District in South Orange County that does not offer a Geometry Honors class.
CUSD is the only district that requires CCP/Stand Alone Health as a graduation requirement.
As a result of these “unique” curriculum choices, the academic performance of students across all demographics continues to decline. Math scores are plummeting and A-G completion rates are poor compared to other districts in south orange county.
CUSD is no longer “the highest achieving large school district in the State”.
Under Kristen Vital's employment CUSD has had a failed Bond measure because there is no trust between CUSD and the Cities that should partner with CUSD to improve the quality of education for students.
Under Kristen Vital we have had the gifting of public assets with the purchase of Essencia School site for $38.86 million- also placed on the consent Calendar without a price. Neither Kristen Vital or Clark Hampton are qualified to Negotiate Real Estate Deals- they are not brokers and this practice needs to stop immediately.
Under Kristen Vital students at Tesoro, since last fall, have had a Toll Road being graded inside school district boundaries and 500' from sports fields and courts without any protective barriers while there are known pesticides and ordnance in the soil. A complete disregard for the health and safety of students and staff at Tesoro.
Superintendent Vital lies to Trustees and allows staff to provide gross mis-information to the Board without any correction.
The District is currently under investigation for illegal campaigning Measure M- Land Fraud - Gifting of Taxpayer Assets and Conflict of interest which is why Trustee Hatton-Hodson has resigned.
Under Kristen Vital CUSD has made no efforts to Communicate and engage the Public or other local agencies and in fact threatened to sue City mayors for voicing opposition to Measure M.
Nothing is working for Students with Kristen Vital as Superintendent. It is time for a change.
In Closing - Kristen Vital knows that CUSD has the power to stop building permits from being issued at the Ranch until the health and safety of students can be protected.

Article 12 of the contract requires that CUSD and CUEA meet sufficiently in advance of the term of the agreement so that there is sufficient time for a new agreement to be reached or for the resolution of an impasse. |

USD has no contracts in place- but the budget assumptions are based on full implementation of what bargaining units are asking for- ie:

If cuts need to be made CUSD starts with unilateral cuts to non-negotiated items - such as books and supplies.
then and only if necessary-
CUSD will look to cuts to negotiated items - starting with class size increases and furlough days. Salary schedule adjustments are always last. That is why when CUSD cut $157 million from its budget during the great recession Teacher salary schedule only decreased by 1.5% and that has been completely restored + a lot more under the State's Road to Recovery plan
