To Protect the Health and Safety of Students and Staff at Tesoro, CUSD's lawsuit needed to include allegations against the Ranch for their part in building the Los Patrones Parkway (aka the proposed 241 Toll Road Extension) within 100' of Tesoro High School, with out the Required Protective Barrier (a 10' high 3,770' long wall).

This map shows the grading limits of the Los Patrones Parkway (aka Extension of the 241 Toll Road).

It is the grading of Los Patrones Parkway, without the required protective barrier that has caused a health risk to Tesoro High School students and Staff.

The Grading limits are within 100' of Tesoro High School property boundaries.

CUSD has a fiduciary duty to protect Tesoro students and staff and was the only party that could have filed an emergency injunction to stop the grading of Los Patrones Parkway until measurements could be verified and the protective wall was put in place

This is the lawsuit that should have been filed by CUSD. Grading started in the Fall 2016 without any protective barrier. It is now 2018 (1 1/2 years later and CUSD has done nothing to protect the students and staff from fugitive dust- noise and air pollution.
