Who is Robyn Uptegraff and why wasn't she named in the CUSD law suit against the County, TCA and CalTrans?

Robyn Uptegraff is the County employee who ADMINISTRATIVELY approved the environmental documents for Rancho Mission Viejo's Waste Water Discharge Permit for "F" Street (aka extension of the 241 Toll Road from Oso parkway to Cow Camp Road.

The noise studies that were done in the original EIR were done on a different alignment:

The Tesoro Extension of the 241 Toll Road was a separate road much farther to the east. Los Patrones was a separate road that was a FREE Arterial road that was at least 500 feet from the High School.

The change in alignment to a single toll road sized road has placed a Toll Road within 100' of Tesoro High School. A toll road is much wider and has higher traffic volumes and speed.

The shift in alignment should have triggered a new review of noise and air pollution effects on Tesoro High School.

The road is less than 100' from Tesoro High School. With no Wall or Vegetative protective Barrier.

The Ranch lied to the water board on its application.

The March 2015 The Final EIR Governing F- Street contained material mis-representations
at page 4-10

Prior to this EIR Tesoro High School had always been designated as a “Sensitive Receptor”. The Addendum to the Final EIR Nos 584 and 589 was intentionally changed to say “There are no sensitive receptors within close proximity to the roadway.”

The alignment of the Tesoro Extension of the 241 Toll Road south from Oso Parkway to Cow Camp Road has been shifted so far to the West, that it is now being graded within 100' of CUSD's Tesoro High School property boundaries, and poses long-term health and safety risks to both the Staff and students at Tesoro High School.

Based on material mis-representations the San Diego Water Board granted the Ranch a waste water discharge permit in March 2015.


Robyn Uptegraff received substantial compensation increases from 2014- 2016
Ms. Uptegraff retired this year. Taxpayers now get the pleasure of paying her pension which was spiked before she left.

LAUGHING ALL THE WAY TO THE BANK

The actions of Ms. Uptegraff demonstrate a complete disregard for the health and safety of the staff and students at Tesoro High School and she should be named in the Capistrano Unified School Districts law suit against the County of Orange.
