CUSDWatch: Tesoro High School Land Parcel 125-096-82 (Toll Road)

RMV encumbered this parcel and should compensate CUSD

CUSDWatch: Rancho Mission Viejo Encumbered Parcel 82 therefore CUSD is Entitled to Compensation.

January 24, 2018 CUSD Board of Trustees Meeting Agenda Item #34 at page 891 CUSD is stating that there are no financial implications as a result of accepting a Quit Claim Deed for Parcel 125-096-82 (Parcel 82), that has always been owned by CUSD, but was transferred to Rancho Mission Viejo by a 3rd party in 2004 in error.

The Ranch has encumbered this land and CUSD is entitled to be compensated.

Resolution No 1718-31 should not be approved until the value of all encumbrances are ascertained.

Specifically, the RMV Deed included all that real property described in Certificate of Compliance No. CC-2001-01, recorded July 26, 2001, as Orange County Recorder Instrument No. 20010508635 (Certificate of Compliance), which included Parcel 82 within an area described as Parcel 4 therein.

There is also still a question of wether or not CUSD owns Parcel 125-096-79. If so The Toll Road is being constructed ON DISTRICT PROPERTY.

Tesoro High School has five parcels of land:

125-096-59 Grant Deed Parcel 125-096-59

125-096-60 Grant Deed Parcel 125-096-60

125-096-69 Grant Deed Parcel 125-096-69

125-096-79* Cloud remains on Title

125-096-82* Cloud on Title just cleared - CUSD owns Parcel 82 (NOT Rancho Mission Viejo)

The boundary for Tesoro High School is the Red Line- A Toll Road is being built less than 100' from Tesoro High School without the required protective barrier (10 foot high, 3,700 foot long wall).

If CUSD is found to own Parcel 125-096-79 then a Toll Road is being built on CUSD property.

CUSD has remained silent on Parcel 79.
