The Grand Jury has acknowledged the receipt of the complaint that sought to protect the students at Tesoro High School from the long term health and safety risks of having a toll road less than 100' from their school.

(1) The Reserve Maintenance Corporation has filed a lawsuit to challenge the Settlement agreement which protected the San Mateo watershed, two state parks and the world famous Trustles surf beach from having a toll road built through them.

(2) The City of San Clemente filed a law suit that also seeks to overturn the protective agreement but is much broader in the sense that it also challenges the Freeway and Cooperative Agreements on the grounds that the parties did not comply with CEQA. The suit also asks the Court to declare that the that the Streambed Alteration Agreement that was approved for F Street/Los Patrones as an "Arterial Road" does not apply to a toll road and therefore the parties must apply for a new agreement with the California Fish and Wild Life Department. The City is asking for a stay while these issues can be worked through.

As an individual that has always sought to protect the health and safety of students and taxpayers within the Capistrano Unified School District, I feel compelled to notify the Public that neither of these law suits protects the students and staff at Tesoro High School.

I filed a complaint with the County of Orange asking that the County issue and temporary Stop Work Order and Conduct a survey to check the alignment of the road that is currently being graded next to the high school to confirm that the alignment is in compliance with the EIR's. The County, despite its obligation to do this work when asked, is choosing to ignore their obligation. THE COUNTY OF ORANGE DOES NOT CARE ABOUT THE HEALTH AND SAFETY OF TESORO STAFF AND STUDENTS.

While the Capistrano Unified School District has signed a Resolution stating that they oppose the Toll Road, they have made no effort to file an injunction with the County asking that this work be done. THE CAPISTRANO UNIFIED SCHOOL DISTRICT DOES NOT CARE ABOUT THE HEALTH AND SAFETY OF TESORO STAFF AND STUDENTS.

Both the Cities of Mission Viejo and Rancho Santa Margarita could file an injunction with the County asking that this work be done. THE CITIES OF MISSION VIEJO AND RANCHO SANTA MARGARITA DO NOT CARE ABOUT THE HEALTH AND SAFETY OF TESORO STAFF AND STUDENTS.

The health and safety risks to students are known by all these parties, but they are not going to take any action to protect students or staff at Tesoro. I felt the Public has a right to know that.

The original EIR mandated that a 10' wall 3,000' wall should have been constructed between the road and the school as a "Protective Barrier". It has not been built and grading of soil that has known Pesticides and possible ordnance has been graded since last fall. Sadly there is not one single governmental entity that cares.
