I am requesting that your office REVIEW the following Permit and Revoke the Permit if what is being built is not in compliance with the permit that was issued.

The Ranch appears to have made false representations in the Application:

1) The Ranch stated in its application that there were no “Sensitive Receptors” in the Ranch Plan Area, and
2) The Ranch only received a permit to build a FREE ARTERIAL ROAD- building the 241 Toll Road Extension is expressly excluded from the permit.
The Following is a timeline that indicates that the TCA, The County of Orange and the Ranch were working together to get the 241 Extension of the Toll Road permitted despite the San Diego Water Board's denial of the TCA’s permit for the 241 Extension from Oso to Cow Camp.

January 17, 2013
On January 17, 2013, the San Diego Water Board released Tentative Order No. R9- 20 13-0007, Waste Discharge Requirements for Foothill/Eastern Transportation Corridor Agency Tesoro Extension (SR 241) Project Orange County (Tentative Order) for public review and comment. The comment period was open from January 17, 2013 to February 25, 2013.
November 24, 2014
An application dated November 24, 2014 was submitted by Rancho Mission Viejo (RMV) (hereinafter Applicant), for Water Quality Certification pursuant to section 401 of the Clean Water Act (33 U.S.C. § 1341) for the proposed "F" Street from "A" Street to Oso Parkway Project (Project).

March 16, 2015
The San Diego Water Board:
1. Adopts the detailed findings as set forth above describing the factual and legal basis of its decision to deny Revised Tentative Order No. R9-201 3-0007.
2. Finds it is unnecessary to reopen the evidentiary hearing for Revised Tentative Order No. R9-2013-0007.
3. Makes no other changes to its June 19, 2013 decision to deny adoption of Revised Tentative Order No. R9-2013-0007, Waste Discharge Requirements for Foothill/Eastern Transportation Corridor Agency, Tesoro Extension (SR 241) Project, Orange County.

The Ranch completed its application and The California Regional Water Quality Control Board, San Diego Region (San Diego Water Board) deemed the application to be complete on April 9, 2015.

Prior to this EIR Tesoro High School had always been designated as a “Sensitive Receptor”. The Addendum to the Final EIR Nos 584 and 589 was intentionally changed to say “There are no sensitive receptors within close proximity to the roadway.”


The alignment of the Tesoro Extension of the 241 Toll Road south from Oso Parkway to Cow Camp Road has been shifted so far to the West, that it is now being graded within 100' of CUSD's Tesoro High School property boundaries, and poses long-term health and safety risks to both the Staff and students at Tesoro High School.
At CUSD's last Board meeting, the District announced that it would be filing a law suit on behalf of students and staff and an emergency injunction was suppose to filed last week.

Here are some basic facts that you may not be aware of:
The alignment of SR-241 Tesoro Extension of the Toll Road has been substantially altered. The extension of the Toll Road from Oso Parkway to Cow Camp Road is now being built on top of what was suppose to be Los Patrones Parkway aka "F Street". Los Patrones was suppose to be a "FREE" Arterial Road (like Antonio Parkway). The extension of the Toll Road was suppose to be a separate road east of Los Patrones.

Because of the substantial shift in the alignment of the 241 Toll Road Extension; and, because the width of a Toll Road is much wider then a Parkway, the road that is being graded is now less than 100' from Tesoro's property boundaries.
In approving the Ranch ’s Permit, Mr. Gibson included the following language:

The Permit needs to be revoked.

Please let me know if a formal complaint needs to be filed with the San Diego Water Board to get a review and revocation this permit.
