Potential Brown Act Violation re: High School Graduation Requirements

May 10, 2017 CUSD Board Meeting Agenda Item #34

CUSDWatch re: May 10, 2017 Agenda Item #34 Board Policy 6146.1 High School Graduation Policies

Note: CUSD collects personally identifiable information on every student in CUSD by embedding Naviance Family into CCP. The Naviance Family terms of service require CUSD to have Parents "OPT IN”. CUSD does not do that, and appears to be collecting data without the expressed consent of Parents . Parents who do wish to OPT OUT- cannot, because CCP is a "Graduation Requirement”, In April 2017, I made a Citizen’s Request to CUSD to place a Discussion of the elimination of CCP and Stand Alone Health as a Requirement to Graduate. I requested that this Item be placed on the June 7, 2017 Board meeting agenda AFTER Trustee Hatton-Hodson had officially resigned her position. In an effort to circumvent that discussion Staff placed this Item on the May 10, 2017 Board meeting agenda. During that meeting Staff handed out an Amended Policy that made changes to the Agenda Exhibit that was made Public in violation of the Brown Act.

The Board agreed to continue this discussion at the Board Workshop on Wednesday, May 10, 2017.

California Government Code section 54954.2(a)(1) Requires the legislative body of the local agency to post an agenda at least 72 hours before a regular meeting. There is no exception to the 72-hour notice requirement for amended agendas. So, handing out an “amended” agenda at the Board meeting is most likely a violation of the Brown Act.
