School Districts Must Fund Art And Music For Every Student

The law requires the District to fund a visual and performing arts education program in two or more arts disciplines at every school site.

Capistrano Unified School District is currently in violation of this law; and must include in its annual budget the cost of a Primary Music Program for all students in grades 1-3, and an art program for all students in grades 1-5 at every elementary school site.

The Capistrano Unified School District has 35 Elementary Schools. The District is currently funding 4th and 5th grade block music for every student. The District is relying on fundraising and donations to pay for Primary Music Programs for Grades K-3. Those schools that cannot raise sufficient funds offer no music and/or art.

Depriving any student of a visual and performing arts curriculum is a violation of their fundamental right to a quality education.

A quality education has been defined by the Courts to be:

“... opportunity to obtain high quality staff, program expansion and variety, beneficial teacher-pupil ratios and class sizes, modern equipment and materials, high-quality buildings.”

The State of California is enjoying record high revenues of over $117 billion dollars... “surplus” revenues. Yet, the State’s new education funding law limits K-12 per pupil funding to 2007-08 levels by the year 2021.

The State has money to adequately fund a quality education for every student, but is choosing not to spend money on K-12 education.

In 2007-08 the State had $105 billion in revenues- today it is over $117 billion.

It is time for parents to stand up for our children. We must demand that CUSD fund a visual and performing arts curriculum for every student. If CUSD does not have sufficient funding to do so, then CUSD must file a negative interim report at this Wednesdays Board of Trustees meeting, and seek additional funding from the State.

The District cannot deny any student their fundamental right to a visual and performing arts curriculum.

Students deserve a quality education!
