On February 8, 2016 Attorney William J. White of Shute, Mihaly & Weinberger LLP representing the San San Onofre Coalition wrote the Orange County Board of Supervisors a letter expressing their concern over the Oso Bridge Project that is currently under construction:
at page 2:
"The Coalition is concerned that TCA is now using the Oso Bridge project as an attempt to circumvent the decision of the Water Boards by building a direct connection between the current 241 terminus and Los Patrones Parkway, a county arterial built in lieu of Tesoro. The bridge appears to have no purpose other than to create a direct connection that would allow the Parkway to effectively serve as an extension of the 241tollroad - in other words, to become the equivalent of the Tesoro Extension. Thus, as with Tesoro, the Oso Bridge project may not be approved until TCA has identified the full scope of the 241 extension project and has conducted a full environmental review of that project as CEQA requires.”
The letter contains over a thousand pages of documentation with correspondence that clearly shows a change in alignment of the Toll Road extension would require a new environmental review and comply with both NEPA and CEQA.”
Dear NEPA Reviewers-
I recently found this letter. I want to bring to your attention that the County Board of Supervisors - the TCA- Rancho Mission Viejo and the Capistrano Unified School District are working in concert to complete the 241 Tollroad extension from Oso Parkway connecting to the I-5 in San Clemente. Since the February 8, 2016 Cease and Desist letter which resulted in a substantial settlement, these parties have in fact chosen Los Patrones Parkway aka F Street as the new Tesoro Extension. I am writing to NEPA in an effort to have this project halted until TCA has identified the full scope of the 241 extension project and has conducted a full environmental review of the project as CEQA and NEPA requires.
Attached please find pictures which will show that the Oso Bridge Connection is being built to connect the 241 at Oso to Loas Patrones aka K Street. Los Patrones has been graded to Tollroad specifications resulting in a road that is so wide that it encroaches inside the Tesoro High School property boundaries and will result in a Toll road that is 500’ from the schools tennis courts and inside school boundaries.
Having a school located less than 500’ from a school poses substantial health and safety risks to students and Staff. The soil around Tesoro has known pesticides in the soil as this was used as agricultural citrus orchards for many years. This land was part of the Trabuco Bombing Range ordnance has been, and continues to be found. The grading has been done without any protective vegetative barriers to protect students and staff. If this project is allowed to continue without the proper environmental review, students and staff will suffer irreparable harm.
In addition, Grading has already encroached into the Chiquita Canyon Wetlands project and the watershed and surrounding protected plants and animals may already have suffered irreparable harm.
The following information will help with your quick understanding of how far this Tollroad has progressed without the required CEQA and NEPA review.

TIME IS OF THE ESSENCE: Unless CEQA is re-opened, the County is planning to issue the Street Improvement Permit (paving permit) immediately.

Please pause this project until we can make sure there are no health and safety issues that would cause irreparable harm to students.
