Child 'Clinging To Life,' Mom's Boyfriend Arrested: Police
"...we have a helpless (6 year old) child clinging to life and neither parental figure can give us a straight answer as to what happened."

SAN LEANDRO, CA — A 6-year-old boy is in the hospital "clinging to life" with a head injury while his mom's boyfriend sits in a jail cell charged with felony assault on a child with force likely to create great bodily injury, San Leandro Police said Tuesday. The accused man is 23-year-old Johnathan Davis. The child, whose name has not been released, has been unconscious and in critical condition since Nov. 21. He's being treated at UCSF Benioff Children's Hospital in Oakland.
Davis and his girlfriend took the unconscious child to Kaiser hospital in San Leandro on Nov. 21. "Doctors there immediately began life-saving measures and discovered that the boy was suffering from a traumatic head injury," police report in a written release. "Soon after arriving at Kaiser Hospital, the boy was rushed via ambulance to Children's Hospital in Oakland where he underwent emergency brain surgery."
Davis told police that the child fell down a flight of stairs while the boy's mother was at work. However, doctors at both hospitals say the boy's injuries are not consistent with a fall.

The boy's mother, whose identity was not released by police, initially backed-up her boyfirld's claim and is now refusing to cooperate with police. The couple have been living together for about 6 months. In addition to the injured boy, Davis' 15-month-old daughter from another relationship lived with the couple. Both children have been taken into protective custody by Child Protective Services.
"This was a difficult case for our detectives and everyone involved in caring for the little boy," said San Leandro Police Lt. Isaac Benabou. "There is definitely more to this story than we know at this time, but for now we have a helpless...child clinging to life and neither parental figure can give us a straight answer as to what happened?"

Davis was arrested on Nov. 29 and appeared in Alameda County court Tuesday. If convicted, he faces 25-years to life in prison. He is being held without bail at Santa Rita Jail in Dublin.
