San Ramon Man Sentenced To Probation For Threatening Sen. Wiener
Erik Triana was sentenced to felony probation after being found guilty of firearms violations and threatening Wiener's life.
SAN RAMON, CA — A San Ramon man was sentenced Thursday to two years felony probation after being found guilty of threatening State Sen. Scott Wiener. During those two years, Erik Triana, 51, is prohibited from contacting Wiener and from possessing any weapons or firearms, according to the Contra Costa County District Attorney’s Office. He must also provide all digital usernames and passwords.
In September, a jury found Triana guilty of seven out of eight felony counts, according to the district attorney. Triana was charged in April after sending Wiener an email that read, “Vax my kids without my permission and expect a visit from me and my rifle.” Triana, a father or three, signed the message “Amendment, Second.” He listed his address as the Moscone Center in San Francisco, an apparent reference to the late San Francisco Mayor George Moscone, who was shot and killed at San Francisco City Hall alongside Supervisor and LGBTQ rights advocate Harvey Milk.
In April, the district attorney charged Triana with threatening Wiener’s life, two counts of possessing assault weapons, two counts of manufacturing or assembling unregistered firearms, and two counts of having a concealed firearm in a vehicle. In September, a jury found he was guilty of all of these except a criminal threat of death or great bodily injury to Sen. Wiener. If he had been found guilty of the more intense form of threatening, he could have been sentenced to as much as three years in state prison and fined up to $10,000, according to California Penal Code 422 PC.
