Teen Not Charged With Murder After Father Impregnated Her, Forced Her To Kill Baby In Northern CA: DA Says

MONTEREY COUNTY, CA — The Monterey County district attorney announced Wednesday evening there are no criminal charges filed against the young teenager who was impregnated by her father and left the newborn to die on a roadside.

At around 4 p.m. on Wednesday, the Monterey County District Attorney's offices sent out a statement clarifying criminal charges connected to the Aug. 1 death of a newborn, the 14-year-old mom and her 38-year-old father Sergio Galvez Perez. Police are still searching for the teen and her father.

"We recognize that the 14-year-old is a victim of her father’s abuse," the press release stated. "No child should ever have to endure such horrific circumstances."

The Monterey County Sheriff's Office issued warrants on Monday for Galves Perez and his 14-year-old daughter. Police initially reported the teen daughter was wanted on suspicion of murder.

But on Wednesday the prosecutor's office clarified the warrants:

"Law enforcement obtained a Ramey warrant, which is a warrant issued by a judge based upon a finding of probable cause," wrote Jeannine M. Pacioni, Monterey County district attorney, in the statement. "A Ramey warrant is obtained through the court and is not reviewed or approved in advance by the District Attorney’s Office. The decision to seek a Ramey warrant is made by law enforcement. Ultimately, only the District Attorney’s Office is responsible for determining whether criminal charges will be filed."

The District Attorney’s office stated that it has not received a filing request for criminal charges against the 14-year-old Jane Doe, nor has their office received any investigative reports from law enforcement.

"As a result, our office has not made any charging decision regarding the 14-year-old Jane Doe," the district attorney's office announced.

Pacioni stated that the district attorney's office has filed criminal charges against Galvez Perez, who is accused sexually assaulting his own child.

"We are requesting a warrant be issued for his arrest, and we call on him to turn himself in and face the charges against him," Pacioni wrote.

On Aug. 1, emergency personnel received a report that a baby had been found on the 100 block of Struve Road. Fire officials confirmed that morning the infant had died.

Police said they learned a 14-year-old girl had given birth to the infant on the side of the road and left the baby, whom investigators are calling “Baby Angelita,” on the ground before leaving.

A postmortem forensic examination concluded there were signs of traumatic injury and the baby still had her umbilical cord attached, officials said.

Police believe Galvez Perez is concealing the teen girl and preventing law enforcement from locating her.

"Our priority is to ensure that this young girl is safe and has access to the support and services she needs," Pacioni wrote.

If the girl is located, the district attorney will connect her with resources and help ensure that she has the support she needs.

"Whether she is currently able to seek assistance or not, we want her to know that help is available and that our office and our community partners are prepared to support her when she is able to access those services," Pacioni wrote.

The district attorney’s office is also looking into potential charges involving the 14-year-old’s mother, which they stated are unrelated to the death of the infant and the sexual assault allegations against Galvez Perez.

"Because the investigation remains ongoing, we cannot comment further on those potential charges at this time," Pacioni wrote.

The sheriff’s office is asking anyone who sees Galvez Perez or the 14-year-old girl to immediately call 911.

Officials warned the public not to approach or confront Galvez Perez.
