Commercial Encroachment into Residential Neighborhoods

RE: Residential Lots Mysteriously become Commercial? What Resident next to new commercial A Lots have to look forward to....

I loved my home! It was a lovely, sweet, peaceful R3 residential location. Close to Downtown, yet far enough away from Promenade to avoid disruptive commercial business noise. 

And then... Our trusted City Staff Attorneys, Planning Dept. and City Council Members supported the "illegal conversion" of The Embassy Apartments into a 24/7 Commercial Hotel, right outside my bedroom window. With the expansion of Valet taking public parking spaces for private use, additional floor service area/space, a large 15 seat outdoor patio with food service and cafe restaurant (trying to be a bar) in the lobby. 
City Staff supported the "illegal conversion" of the Embassy Apartments, into the Pailhouse Hotel, because TOT tax on $350 to $1,000 per night brings in big buck$.  It's clear to me City Staff wanted this "Historical Landmark Building" to attract and benefit tourist and support City Staff pensions. Residents do not matter to them.

The City Attorneys Failed to bring any evidence before the court about the "illegal hotel operation" in the 80's and 90's, or to present needed evidence about he residential status of The Embassy Apartments. The Embassy owner was denied a Hotel exemption in 1980 by RCB. The staff report states the owner admitted that virtually every unit was rented to a permanent residential tenant. Any use, of rent controlled units, as Hotel rooms after the denial is Illegal Hotel use. Not one Embassy owner ever paid one penny in TOT as required by law to operate a Hotel. Planning Staff falsely made claims about the existence and operation of a kitchen for food service. RCB just did what the city told them to do. So much for an independent board. 

Marsha Moutrie sent me an e-mail saying i should file a nuisance law suit. That is the City Staff's answer the their Illegal Actions... Sue if you can. Because, they know the average resident, does not have the resources and/or ability to hire a $400 an hour attorney, our City Staff does as they please. They depend on this! 

This morning the noise started with maintenance illegally washing the porch, walk ways and patio down at 6:30 am right outside my bedroom window. They serve food on the front patio with 15 seat below my bedroom. Guest use the patio as their personal office space, talking on their phones at all hours of the day and night. Valet is incredibly disruptive with cars idling, doors and trunks slamming and people shouting. Guest come and go causing noise and waking me up at all hours of the night. The ONLY time it's pleasant is 2am to 5am. At least i can count on 3 hours of sleep and should be grateful for that. Other then that it's a nightmare.

This is what residents who live next to the "Scandalous A lots' (residential lots mysteriously turned commercial during the LUCE process, with out notice or community input) have to look forward to.... Commercial businesses destroying the peace, quiet and enjoyment of their once lovely homes. Not to mention the diminished value of the residential properties next to these newly created commercial A lots.

Ok just ranting and i feel so much better now!
