For 3 years the State, County and two cities have done nothing to prevent cancer causing fumes depicted in a County Air Pollution Control District aerial photo as a green cloud over 2,125 homes, 3 schools, a pre-school and thousands of acres, being emitted from the Sycamoe Landfill near Santee. Landowners and parents of students at the schools have not been notified. The APCD has labeled the area a TOXIC HOT SPOT, creating an unknown impact on property values.
Now, two senior citizen landowners having found a City of San Diego agreement with the Federal Government, recorded as CC&Rs, restricting the landfill to 113 acres, which was full over 20 years ago have filed suit to enforce the agreement and close the landfill. Plaintiffs are supported by twenty senior citizens who have signed declarations in support of enforcement of the CC&Rs. If the court grants trial preference, afforded some senior citizen plaintiffs, trial would be within 120 days, based on California law. The original City of San Diego landfill permit, CUP 6066, required fumes and odors be confined to the 113 acre site, and be out of the publics' sight below the ridge. Today the landfill property is over 500 acres and in sight of its neighbors.
