Going to court on a family law issue does not have to be combative. Based on my experience as a family law attorney, if you can work on the following five tips, you can achieve a less stressful and more productive way of handling your case.
1) Avoid the negativity. Nothing good can be worked out if you come to court or a meeting with a chip on your shoulder. Try to put those negative thoughts aside, at least for the time you are trying to work out a solution. Try to use positive communication. This is not the time to bash the other party. The focus should be on how to get what you want and at the same time how to achieve what the other person wants. Starting on the wrong side, will not get you anywhere, but only prolong the process.
2) Think of your outcome. What will make you happy and how can you help the other party get what they want in exchange of what you want or need.

3) Think of the children. Majority of litigation involving custody issues, what the parent wants, but the main focus should be on what the children need. In California, like in other states, the goal of the court is to provide meaningful contact between both parents and children. Don’t think you will take away the other parent’s rights to contact their children. Those cases rarely happen unless there is clear evidence of abuse or neglect. Focus on how the children can maintain a relationship with the other parent. You also need to understand that you will need to communicate with the other parent, so it would be ideal if you could start now on working together for the sake of the children.
