MONTEREY COUNTY, CA — The Monterey County Sheriff's Office received confirmation that 14-year-old girl who investigators believe had been impregnated by her father has been rescued by Mexican law enforcement and her father has been arrested, the office said Sunday.

The Amber Alert was issued Sept. 6 for Diana Galvez Ortega and her father, Sergio Galvez Perez.

The Sheriff's Office believes that Galvez Perez committed incest against his teen daughter and that she abandoned an infant who was fathered by him shortly after giving birth a little over two months ago. Authorities have named the deceased infant "Baby Angelita."

On Sunday, Sheriff Tina Nieto said Galvez Perez was also arrested in the Mexican operation.

"Monterey County Sheriff's Office detectives have worked closely with the FBI and Mexican authorities to secure Diana's safe rescue," Nieto said. "During the rescue operation, Sergio Galvez Perez was arrested after he was found in possession of narcotics. Mexican authorities are aware of the pending charges against him in Monterey County for crimes committed against Diana. Diana is safe and is currently in the care of local authorities in Mexico."

The case garnered a lot of attention after Nieto initially announced that there was probable cause to arrest the teen for murder. The Sheriff's Office also initially said the case did not meet the right criteria for an Amber Alert to be issued.

Pushback from Supervisor Wendy Root Askew and the community lead the District Attorney's Office to release a statement that it hadn't charged the girl with anything. Prosecutors have however filed charges against Galvez Perez "for the heinous crime of sexually assaulting his own child."

The Sheriff's Office said it will be releasing more information but for now they are only reporting that Galvez Ortega is safe and that Galvez Perez is in custody.
