Mischa Barton Sued By West Hollywood Homeowners Association

WEST HOLLYWOOD, CA – After allegedly damaging a plaster-covered awning over the entrance to a property by crashing into it with a rented moving truck, Mischa Barton was sued Wednesday by a West Hollywood homeowners association. The Park Wellington Owners' association's Los Angeles Superior Court lawsuit alleges negligence and seeks nearly $27,000 in damages.

The entryway structure was not high enough for the truck to pass under it when the incident occurred Feb. 11, the suit states.

"As a result of Barton's attempt to do so, the top of the vehicle struck the overhead support beams of the entry way, causing significant structural damage to the association's property," the suit alleges.

A representative for the 31-year-old actress could not be immediately reached. A large sign in front of the driveway to the property states that no commercial vehicles are allowed, the suit states.

A police report stated that Barton was at fault for hitting the awning and for speeding, the suit states. The city of West Hollywood had to post an "unsafe" sign because the damage to the structure was so severe, the suit states.

The association demanded that Barton pay for the damage, but she said a former boyfriend, Adam Spaw, rented the truck, according to the lawsuit. Spaw's insurance carrier denied the association's claim and Barton still refuses to pay for the damages, the suit states.

Barton has obtained a stay-away order against Spaw. The celebrity website that employed the photographers who were following the former co-star of "The O.C" posted a video of the crash, the suit states.
