Company Sued Following Trade Secret Violation Claims, Among Others

Florida business says ex-employee leaked confidential information to Evolution1, where he now works.

A Florida company is suing Evolution1, primarily based in Avon, claiming that a former employee leaked confidential Consumer Health Technologies-P&W Software Inc. (CHT-P&W) information to its competitor, where he currently works as vice president of sales.

The complaints include "misappropriation of trade secrets, breach of contract, unfair competition and other illegal activities," www.masshightech.com reported mid-April. CHT-P&W also accuses Evolution1 of "intentional interference with prospective economic relations, aiding and abetting, trade libel and unjust enrichment," according to court documentation.

Evolution1, which has offices in Avon, Fargo, ND, Minneapolis, MN and St. Louis, MO, specializes in "electronic payment solutions and software for the employee benefits market," according to a company press release on its website.

Global law firm Orrick, Herrington & Sutcliffe LLP is representing the complainant, www.masshightech.com reports. CHT-P&W is a healthcare software company is based in Fort Lauderdale, FL, according to the website.

The lawsuit seeks damages, identifying Evolution 1's Fred "Bud" Bockoven as a previous employee of the complaintant, according to www.businesswire.com. Bockoven, a California resident, was the director of sales and marketing there, according to court documentation. A press release announcing that Bockoven was hired at Evolution1 in February 2011 notes that he was the former P&W executive.

The lawsuit was filed in the Superior Court of the State of California on April 13, according to court documents available on CHT-P&W's website.

Evolution 1 was established when Evolution Benefits and Lighthouse 1 merged July 11, 2011, according to its website.
