Bethel Company Sues Rutgers for Nixing $81M Science Building Contract

Bethel-based Worth Construction Co. Inc. is accusing Rutgers University of improperly terminating their $81 million contract.

Bethel-based Worth Construction Co. Inc. has filed a lawsuit, accusing Rutgers University of improperly terminating its $81 million contract for a new science building, according to Law360.com.

In their Oct. 28 complaint Worth Construction Co. Inc. said they were “willing and able” to complete its work on Rutgers’ chemistry and chemical biology building, but that the university nixed the contract. The university apparently canceled the contract due to issues with scheduling delays and agreed upon costs of the project.

“Rutgers’ termination of Worth’s contract was without any basis in fact and was wrongful. As a result of the wrongful termination of Worth’s contract, it has suffered substantial and significant damages, including but not limited to costs incurred for work performed which have not been paid for by Rutgers, lost overhead and profit which would have been earned had the contract not been wrongfully terminated and damage to its reputation and good name,” the complaint said.

The university allegedly demanded that Worth provide a recovery schedule stating how they planned to complete the project by the Sept. 2016 date, according to the complaint. Rutgers advised Worth on Sept. 2 that it was canceling the contract.
