Danbury Man Nets $190K Settlement After Fall in Icy Lot

DANBURY, CT —A Danbury man who injured his eye and shoulder when he fell in an icy parking lot has settled his lawsuit for $190,000, the Connecticut Law Tribune is reporting.

Andres Reyes, 69, fell on accumulated ice in the parking lot at Danbury's Kimberly Place Apartment complex in February 2016. According to the lawsuit filed in January 2018, Reyes' injury was due to the "negligence and carelessness" of the apartment complex ownership and management.

The parking lot, where ice had been allowed to accumulate untreated, was inadequately lit, and no warnings were posted, according to the complaint.

In papers filed last July, lawyers for the Kimberly Place complex blamed Reyes for the fall, claiming that the plaintiff was inattentive and failed to keep and maintain a proper lookout, wear proper footwear, or make "proper use of his own senses and faculties."

The final $190,000 is a bit of a compromise, according to the CT Law Tribune, as Reyes' team had sought $250,000, while the defense had made offers for $75,000. The settlement comes just one week before trial was scheduled in Danbury Superior Court.
