Metro-North, Darien Family Reach Settlement Over 2013 Death: Report
Darien resident Kevin Murphy was killed in 2013 after he was struck by a train at the Norton Heights Train Station.
STAMFORD, CT — Metro-North Railroad and the family of a Darien man who was struck by a train and killed in 2013 have reached a settlement, according to a report from CT Insider.
Details of the settlement are not being released because of a confidentiality agreement, CT Insider said.
Kevin Murphy, 55, was standing on the Norton Heights train platform around 6 a.m. March 4, 2013.

A police report indicated that he slipped on some ice and fell off the platform and onto the tracks, the CT Insider reported, adding that a train passing through the station at 70 mph struck and killed him.
A lawsuit filed by Murphy's family claimed that the train shouldn’t have been on a track next to the platform because it wasn’t scheduled to stop at the station.

The lawsuit was thrown out by a state Superior Court Judge in 2017, CT Insider said, but the state Supreme Court ruled in 2019 that the case could proceed.
Murphy's family previously settled with the town of Darien and Wilton Enterprises, the manager of the train station.
Murphy was a managing director at Brooks, Houghton & Co. Inc. He left behind his wife and five children. He was an accomplished equestrian and enjoyed spending time with his family, according to his obituary.
