40-Unit Fairfield Apartment Complex Wins CT Supreme Court OK: Report

The complex was ushered in under the state's 8-30g affordable housing law.

FAIRFIELD, CT — A planned 40-unit affordable apartment complex at 131 Beach Road in Fairfield received approval from the Connecticut Supreme Court earlier this month, CT Insider reported.

The developer of the project, which will sit on the site of a former Masonic Temple, filed suit with the state supreme court objecting to height requirements imposed by the Town Plan and Zoning Commission.

Commissioners had sought to cap the project's height at 40 feet, but the court ruled in favor of the developer, in part because the height restriction would have reduced the number of affordable apartments.

The complex will hold 24 two-bedroom units and 16 one-bedroom units, and was ushered in through the state's 8-30g affordable housing law.

Neighbors and town residents opposed the project, reportedly because it could increase traffic in the neighborhood, and could cause safety issues.
