Fairfield ZBA to Hear Appeals Over Affordable Housing Eligibility Violations

FAIRFIELD, CT — The Fairfield Zoning Board of Appeals is scheduled to hold a public hearing Thursday on two appeals challenging zoning enforcement actions tied to affordable housing eligibility requirements under Connecticut law.

The meeting will begin at 2 p.m. on Thursday, June 4, in a hybrid format, with in-person attendance available in the first-floor conference room at Independence Hall, 725 Old Post Road, and remote participation available through Zoom (Passcode: 123).

The board will review separate petitions from owners of properties on Westway Road seeking to reverse or modify decisions by Fairfield's Zoning Administrator.

The board is scheduled to consider an appeal from Michael Liskov regarding a notice of violation issued for a property at 489 Westway Road. According to the agenda, the violation concerns the purchase of a dwelling designated as affordable housing under Connecticut's 8-30g affordable housing regulations by individuals determined not to qualify for the program.

A similar appeal is scheduled for 461 Westway Road, where petitioner Glen Tatangelo is seeking to reverse or modify a notice of violation related to the purchase of an affordable dwelling by individuals alleged not to meet eligibility requirements under the state's 8-30g regulations.

Both properties are located in the DRD Zone.

In other business, board members are expected to discuss a range of zoning administration and procedural topics, including application materials, enforcement challenges, application review procedures, hearing guidelines, hardship criteria, decision-making practices, project compatibility with neighboring properties, and oversight of construction projects.
