Motorcycle Accident Victim Awarded Nearly $143,000

The New Britain man and a Farmington woman collided in August of 2012.

On Aug. 7, 2012, Kenneth Perry was riding his motorcycle when he and Farmington’s Marzena Bakowska collided.

While the details of the accident vary, the result was Perry’s motorcycle slamming into Bakowska’s minivan and Perry landing on the passenger side of Bakowska’s vehicle. Perry, though wearing a helmet, was knocked unconscious and was taken by ambulance to the hospital.

He suffered a concussion but was treated and released after undergoing numerous exams for the head injury. He also had neck and low-back pain that persisted.

Perry sued Bakowska for damages.

The case went to trial in Hartford Superior Court last month and the defense offered $15,000 to settle. The plaintiff wanted $19,000. Perry’s lawyer, Xavier Pryor, said his client was willing to go as low as $17,000, but the defense would not budge off of $15,000.

After roughly two days of testimony and a day of deliberations, the jury awarded $142,966, but jurors also found Perry 10 percent at fault, reducing the verdict to $128,669.
