Appellate Court Rules Against Madison and Madison Beach Hotel

The hotel and the town's Planning and Zoning Commission sought the re-creation of the West Wharf District.

A State Appellate Court sided with a group of concerned Madison residents and ruled against the town and the Madison Beach Hotel and the re-creation of the West Wharf District, the New Haven Register reports.

What this essentially means is that the hotel will remain in a residential zone and the Madison Beach Hotel must comply with its 2008 agreement with the town, which includes restrictions on outdoor lighting, the number of people allowed to attend banquets and parking requirements. A total of 24 variances were agreed to at the time.

The town Planning and Zoning Commission sought to create the West Wharf District so it could approve Madison Beach Hotel matters, but that was denied by the appellate court, and the Madison Beach Hotel must still get its approval from the Zoning Board of Appeals, the Register reports.
