“When Referral Sources are Not Happy with Me”

Strive, as I may, for perfection when it comes to doing each and every mortgage and create a raving fan. I don’t always succeed and fall short, but I’m not willing to lose my license for anyone. 

I received a call from an attorney who wanted to refer a client. He told me that he had been referred by a colleague, that said good things about me. He gave me an overview of the situation and flags went up immediately. His client was living with someone who was currently in foreclosure and he wanted her to buy the property as a short sale. 

The attorney didn’t like it when I said, that I was not willing to be a party to fraud. He wanted to know how I considered this to be fraud. So, I asked a couple of questions: 

1) Does she live in the home? Answer yes
2) How long has she lived there? Answer 4 years
3) Has there been any attempt to make any payments or bring the mortgage current? answer no
4) How long has the property been in foreclosure? Answer 4 years
5) Have you represented to owner in the foreclosure? Answer yes 

The attorney then told me that the existing note holder doesn’t care who buys the property, they just want the property sold. Can you get me something signed by the foreclosing party, indicating they are aware of the 5 questions that I asked and indicate, they don’t care that she is the buyer, then I’m willing to go to the next step. 

He told me, he thought it would be best for him to contact another mortgage person who might be more enthusiastic about this “DEAL”. I said, that was a good idea and then click.
