Michelle Troconis Invokes 5th Amendment In Civil Deposition

The lawyer representing Jennifer Dulos' mother is asking a judge to compel Troconis to answer questions in a civil lawsuit.

NEW CANAAN, CT — The lawyer representing Jennifer Dulos’ mother is asking a judge to compel Michelle Troconis to answer questions from a Sept. 25 deposition in civil court.

Gloria Farber is suing Fotis Dulos. She alleges in the lawsuit that Dulos didn’t pay back loans made to his real estate company Fore Group and used the money for personal instead of business needs.

Troconis, who is Dulos’ ex-girlfriend, invoked the Fifth Amendment for all questions in the deposition. People can invoke Fifth Amendment rights if their testimony could be used to incriminate them.

Dulos and Troconis have pleaded not guilty to evidence tampering and hindering prosecution charges in a separate criminal case related to the disappearance of Dulos’ estranged wife Jennifer Farber Dulos.

Farber's attorney Richard Weinstein contends that Troconis' answers to the questions would have no bearing in her criminal case. He is asking the court to review a transcript of the deposition and compel Troconis to answer questions.

“Ms. Troconis, upon information and belief, has knowledge of the affairs of the Fore Group, and was involved in representing it in one capacity or another for some period of time,” Weinstein wrote. “Her testimony is therefore quite significant in regard to the conduct of Fotis Dulos and the Fore Group in maintaining, or not maintaining a separate corporate identity and use of corporate funds.”
